Commercial Conveyancing

 

At Solomon Shepherd Solicitors, we act for landlords and tenants of retail premises, offices and warehousing. We deal with all aspects of estate management, including granting, assigning and terminating leases, enforcing lease covenants and advising on defaulting tenants and lease renewals.

 

We deal with all aspects of commercial property and can also assist with the acquisition and disposal of freehold and leasehold premises.

Independent Legal Advice (ILA)

 

Lenders almost aways require persons providing personal guarantee of loans to obtain Independent Legal Advice. In a landmark case, the court explained that banks are legally obliged to make sure that all borrowers obtain independent legal advice from a solicitor before signing their finance documentation. This applies to persons providing personal guarantees. This may be a Director of a company or a Trustee of a Charity.

 

A solicitor will certify that they have explained the terms of the finance documentation to the borrower and that they are satisfied that the borrower has signed the documents of their own free will and without undue influence or duress. This is referred to as Independent Legal Advice.

 

There are also instances where consent is required from an occupier to a Mortgage. Here at Solomon Shepherd Solicitors Ltd we provide Independent Legal Advice. We peruse the documents and advise you of your obligations under the agreement.
